The Clearinghouse is an online database that will contain records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information will also be recorded in the Clearinghouse.
As of 1/6/2020 the FMCSA regulated this to be a mandatory process for any new hires that hold a CDL. Employers and TPAs will be able to pull pre-employment, full, and limited queries to meet the new federal requirements.
In order to conduct these searches, employers will need to purchase a query plan ($1.25/query) through the Clearinghouse directly.
A query is an electronic check in the Clearinghouse, conducted by an employer or their designated TPA, to determine if current or prospective employees are prohibited from performing safety-sensitive functions, such as operating a commercial motor vehicle (CMV), due to unresolved drug and alcohol program violations.
There are two types of queries, limited queries (which satisfy the annual query requirement) and full queries (which include all pre-employment queries). All queries require driver consent; the type of consent depends on the query type.
