What is it?
The Texas Employee Misconduct Registry (EMR) is a state-maintained database managed by the Texas Health and Human Services Commission (HHSC). It lists unlicensed personnel who have been found to have committed acts of abuse, neglect, or exploitation against residents and consumers.
How does it work?
Verified First queries the Texas EMR database using the candidate's Name and Social Security Number.
- Clear Result: The candidate is not listed in the registry.
- Record Found: The search returns available details of the recorded misconduct. If an individual is listed on the EMR, they are permanently prohibited from employment in HHSC-regulated facilities under Texas law.
Who needs this search?
This search is critical for Texas employers who serve vulnerable populations. You should run this search if you are a:
- Long-term care facility
- Home health agency
- Other State-regulated healthcare provider
Why run it?
Texas law requires certain facilities to verify that an applicant is not listed in the EMR prior to hiring and annually thereafter. Running this search ensures you remain compliant with state regulations and protects your patients from individuals barred from direct care positions.
⚠️ Important Compliance Advisory: EMR vs. TULIP
This product only searches the Employability Status Check Search. Many Texas facilities are legally required to search the Texas Unified Licensure Information Portal (TULIP), which is the comprehensive check covering both the Employability Status Check Search and the separate EMR. To ensure full compliance with state regulations, especially for roles requiring licensure or certification, we strongly recommend viewing our Texas Unified License Information Search article.
